Negligent Security

While you may feel that a property owner is protecting you from danger (negligent security, inadequate security), it is often the case that property owners put profits over safety, and when that happens dangerous predators seize the opporunity to attack.

Assault – Violent Crimes

Threats to Harm

If you have been hurt as a result of intentional and unlawful touching (an assault) by another person, you can sue the offender, seeking compensation for injuries and other damages stemming from the incident. Many people assume that these are only criminal acts; however, victims who receive personal injuries can pursue civil claims in court.

An assault is defined as an intentional and unlawful threat, by word or act, to do violence to another person, with the apparent ability to carry out the act, and as a result the act created in the mind of the victim a well-founded fear that violence was about to occur.

Assault cases can include a simple assault, including verbal threats accompanied by threatening gestures or aggravated assaults (an assault with a deadly weapon without the intent to kill; or with the intent to commit a felony). Assaults also include sexual assaults.

Assaults are often the result of arguments or fights that got out of hand (couples quarrel, family disputes, neighbor disputes, passionate sports fans, bar fights, gang clashes and school student fights). Sometimes assaults escalate and become a battery.

It is not uncommon for assaults to occur in nightclubs and bars, malls, parking lots, apartment complexes and college campus were a property owner lacks the proper safety and security measures. In many cases, the owners and employers negligently hire aggressive employees or negligently retain aggressive employees, even after learning of the employees violent and dangerous behaviors. Some employers also fail to perform adequate background checks including any past criminal behaviors by not completing a criminal background check. This puts residents, students, employees, customers, and guest on their property at great risk for serious personal injuries.
