The majority of people go to Florida nightclubs, bars and taverns for an evening of fun with friends and relaxation; however, anytime alcohol is being served to a diverse crowd, late at night, in a packed venue, and with limited security, the potential for assaultive behavior exists.

Bar and club owners have a duty to protect its customers from violent acts, such as assaults, batteries, and other conduct by their employees (bar tenders, bouncers, wait staff) and third parties (patrons, vendors). A club owner may be liable for patrons injuries if their employees instigate a fight, fail to prevent a fight from happening or allow people in with weapons. A business owner may also be liable for violent acts and injuries that occur outside of its establishment (parking lot) due to inadequate or improper security. A bar owner who has a history of violent activities is even more susceptible to liability for future incidents, since they should have know and taken preventative measures.

Common Causes of Negligent Security at Bars & Taverns


Unfortunately, many of the victims in these assaults and fights are innocent bystanders. Victims often suffer broken bones and fractures, permanent injuries, catastrophic injury, brain damage, and in some cases, wrongful death.

Florida does have a Dram Shop law. Dram shop laws hold a bar, night club or restaurant owner, as well as their servers, responsible when a guest injures or kills them self or another person after the bar, restaurant or night club allowed that guest to become visibly intoxicated at their establishment. Claims may only be brought by or on behalf of a minor or habitual drinker.

In a recent case that our law firm handled, we obtained a $2,000,000 jury verdict for a patron who was attacked by another patron at All Stars Sports Bar & Grill.
